Sales Tax on Pellets in NY

OK , so I have been buying pellets from Home Depot for the last few months ...no sales tax
Just found pellets at True Value and didnt realize till I got home ...they charged me sales tax
So...I give TV a call and they say they dont know anything about no sales tax
Anyone know what gives here?
 
Never paid sales tax on any of my pellets.

I've never paid tax on pellets either. Unless the law has changed (man I hope it hasn't), there is no tax in New York on pellet fuel.

When I bought 5 tons last May, the guy at first added tax, but when I reminded him there is no tax, he said, "Oh yeah" and took it back off. He made an honest mistake, but when reminded he did remember. Sounds like your True Value needs some education, unless, as I said, the law has changed.

True Value was really not to receptive to my trying to educate them what the deal is
If I can find something to print from NY state I will
otherwise I will forget it and consider it a tip
I was just happy to find that they had a quality pellet from canada
and I love those canadian pellets , pellet whore that I am

This is the "NYS Local Sales and Use Tax Rates On Residential Energy Sources and Services" form.

Look at Part 2, and that lists all the places in NY that CAN charge for pellets. If the area where the True Value is located isn't on the list, print the form out and show them, then demand your $$ back.

Just got nailed with tax in Glenville NY Walmarts...they JUST started charging 4% tax Jan.09 even though they could have charged starting in Sept 08....can we plz get a break this coming year I hope...how much will they bleed us this year..$350 a ton then add tax maybe????its always possible...I was paying $240 last year then had to pay $300 later in the year so if they could jack prices $60 why not do it again..you know they reallllly need the money..$350 will totally break me for heating my house..$7 a bag would be just RIDICULOUS if that becomes the norm

I was speaking with a mom an pop store why they raised prices and they told me point blank it was because they were getting charged $100 more a TRAILERLOAD.!!!...TRAILERLOAD!!!!..a 53 footer holds 44 pallets stacked..you mean to tell me that $100 per load justifies making us pay $2600 per trailer...something wrong here

I guess they figured you wouldn't do the math......

Actually every county doesn't have tax on solid fuel...I'm in Orange County...no tax on pellets, and the other counties right around me don't have tax on pellets either. It's kinda hit or miss in the state on which ones do.......

44 stacked woud be slightly overweight. How about 22 pallets per load.
 
Ok so I bought alot of pellets back in September. I still have my receipt and they charged me 8% tax. I live in cortland county where it says 4%, do you think if I went there they would refund the tax money they owe me? It would be about $47
 
They charged me 3% , so looks like they know what they are doing , I am in westchester county

As long as you bring a copy of that NYS tax info I put in the post above, I don't think they'd have any choice....it went into effect on Sept. 1.

And if they say no, just tell them that they are forcing you to contact NYS Tax dept. and turn them in.
