Pioneer III chimney air kit installation

We have a Pioneer III fireplace installed in a new construction house. I have been having a discussion with the installer about the way the chimney outside air kit has been installed. Maybe I am wrong, but his routing of the flexible pipe is nothing like the installation manual calls for. It would seem to me that to keep the cold air out (which the manual seems to indicate the P-Trap is for), the flexible pipe should go upward immediately upon entering through the chase wall and make the inverted "P-Trap"and then down to the base of the chimney pipe where the flex pipe attaches to the chimney pipe.

If you can't tell from the picture, they have the flexible pipe (smaller one is for the chimney) hanging lower than the top of the fireplace and then back up to attach to the chimney. He says that it the P-Trap.

Picture of the current installation and the manual attached. They are using the SL-300 flue and the required CAK4A (chimney air kit). I am new. Please be kind if I am being a total idiot. Thanks.
