Could be a modern UL Listed Jotul (602 I think?) with double wall black pipe. If that's the case it might just meet the min clearances.
 
Yeah, pipe looks big (double wall)...although you are right - by the letter of the law, loose curtains should not be that close because they can move!

Lots of "failing" installs in the gallery, I'm sure. I've always noticed a bunch in manufacturers brochures also.
 
Seeing gross safety violations in manufacturer brochures is a pet peeve. It puts bad ideas into peoples heads that don't realize the fire is Photoshopped in.
