That little guy is looking for a mate or = marking his territory and that metal termination rings out his message much better that a wooden pole. (I watched a woodpecker hammer on a metal light pole = for several days before he got a response). Generally, given time, he'll move on.   Chimney Sweeps have dealt with birds for years. The fact is theres really nothing you or the doctor can do because that little guy is protected = under Federal Law. Under these laws you can not interfere with the courting, nesting, rearing or general procreating of protected birds. The National Chimney Sweep Guild and related forums deal with problems created by protected birds every year, there are only four birds on the North = American continent that aren't protected and none of them are woodpeckers. The literal interpretation of this laws can get pretty ambiguous and open to interpretation. Some might argue that removing the DV pipe is interfering....   If your doctor is being nasty about it contact the Feds (Fish and = Wildlife) with your doctors problem and explain to them your concerns over protected birds and the doctors sanity. cc your correspondence to the good doctor. I don't think his attorneys would want to take on the Feds.   Better yet get the Doctors attorneys to recommend, in writing, a remedy.
